      Gravotech, Incorporated(GVT) warrants the Computerized Engraver (Equipment) to be free of defects in material or workmanship during the basic Warranty period. The basic Warranty period is defined as one (1) the calendar year of parts and onsite and a second year parts only from invoice date. This Basic Warranty does not apply to Equipment shipped to Alaska or outside the U.S., this basic Warranty policy does cover Equipment shipped to a Government location.Basic Warranty services apply only to manufacture’s defects that develop while the Equipment is used in the ordinary course of business and in the manner for which it was intended.If any manufacture’s defects occur during the Basic Warranty Period, GVT shall, at its sole option, and at no cost to the customer, repair or replace such items and provide such labor as is necessary to restore the Equipment to satisfactory operating condition (Basic Warranty Services). Such Basic Warranty Services shall be provided during normal working hours by a GVT authorized Field Service Engineer or the Duluth Depot Repair Center. The customer shall prepay all transportation and insurance charges for returning the equipment to a customer location.Notwithstanding the foregoing, GVT shall have no obligation to provide any Basic Warranty Services on the equipment for damage or malfunction caused, directly or indirectly, by accident, fire, flood, explosion, earthquake or other act of God, or by civil disorder, war, strike, labor dispute, labor shortage, or the deliberate or the negligent act of any person other than a GVT employee, or by the misuse or abuse of the Equipment.THERE ARE NO OTHER WARRANTIES, EXPRESSED OR IMPLIED. GVT MAKES NO REPRESENTATIONS AS TO THE SUITABILITY OR MERCHANTABILITY OF THE EQUIPMENT.  GVT shall not be liable to the customer for any delay or failure in performance hereunder, or, for any inter­ruptions in the operation of the Equipment or any other aspect of the customers business, which may result directly or indirectly from unavailability of transportation, parts, or materials, or from accident, fire, flood, explosion, earthquake or other Acts of God, Civil disorder, war, strike, labor shortage,failure of the customer to provide standby equipment,or the deliberate or negligent act of any person other than a GVT employee,or the misuse or abuse of the equipment,or any other cause,which cause is beyond GVT reasonable control. In no event shall GVT be liable for any indirect, consequential, or special damages regardless of the form of the action, arising from or incidental to the performance by GVT under this basic warranty. GVT shall have no responsibility or liability whatsoever concerning any damage to any software, or any indirect, consequential or special damage that may arise from any damage to software, GVT liability hereunder shall be limited to the amount of any sums paid by the customer to GVT for the purchase of this equipment.
